This brief paper is intended to provide an overview of some of the emerging situations and issues. This is not intended to be an in depth analysis of a specific topic – although ESM does perform this service for clients – but does provide enough of an overview so that people can have a broader view. Within the document, the following items were noted:
• General Issue
The current situation is that the piracy issue is now taking on three new fronts. The first is the traditional piracy issue that involves pirates, etc. The second element, however, involves the response to piracy and the potential impacts that those responses are having. The third impact is in the significant presence of military forces and their approaches within the area.
Scope Limitation
This discussion paper does not seek to provide legal advice, but only to put forward a sound evaluation of concerns that may arise as the result of undertaking certain security measures during anti-piracy operations. Those seeking legal advice should seek appropriately trained and lettered members of the legal profession that can demonstrate competence and currency within the field.
Similarly, while this document reaches a conclusion, it is reiterated that any security safeguard should be based upon a properly conducted risk assessment involving trained (ideally certified) security personnel with experience in the domain. Each situation should be weighed on its own with the safeguards ensuring appropriate protection for life, property and operations.
While the piracy issue is global in nature, this report focuses on the Gulf of Aden and Somalia area due to changes in conditions and the information received.
